Michael Jackson's Dad Smells Bad in MJ Perfume War

A company that owns the rights to license all things Michael Jackson is going after MJ's dad, Joe -- indirectly -- claiming he's involved in a business deal that shamelessly exploits his dead son.

TMZ broke the story ... Joe Jackson was pushing the new "Jackson" scent line at the Cannes Film Festival last month on behalf of a company called Julian Rouas Paris. But according to a new lawsuit, J.R.P. never obtained permission to use Michael's name and image in connection with the product.

Now, Bravado International is asking a federal court in Los Angeles to force Julian Rouas Paris to immediately strip anything MJ-related from their smelly product line ASAP.

Bravado is also seeking $750 for each time MJ's name and likeness were used on a product PLUS three times the amount of profits they've made on the scents PLUS more than $150k in damages.

A rep for Bravado tells TMZ, "Michael Jackson's talent made his name one of the most valuable in the history of entertainment, and no person acting on behalf of the estate gave Mr. Rouas oral or written consent to exploit it."

    "Smells Bad" in the title. We know of all the "Bad" references in the hoax - the images used at the Memorial and funeral, etc - indicating the time when the hoax plan started. Smells Bad - sniffing out the death hoax?
  • I guess this TMZ article is to draw attention to the MJ merchandise, copyrights and Bravado. Bravado is legally specialized in protection of copyright infringement and unfair competition. We should be aware of MJ merchandise for sale online, which could be fake, unauthorized or for prices 3 times (or more <!-- spale/ -->pale/<!-- spale/ --> ) higher.

    Michael Jackson continues to be a money making machine and there is another fight over who is getting a piece of the merchandising pie. Bravado International is suing website Emoda.com for copyright infringement and unfair competition.

    Bravado has been selling Jackson merchandise exclusively through an agreement with Triumph International- a company owned by the Michael Jackson estate which controls all rights to the pop star’s name, likeness, and trademark including the nickname ‘King of Pop.’

    The company is alleging that Emoda.com have been distributing and selling unauthorized shirts and other items bearing Jackson trademarks, likeness, artwork, and photographs “that lead the consuming public to believe that said items are sponsored by or associated with and/or affiliated with Michael Jackson and/or his estate and/or plaintiff.

    “Their infringing activities are particularly defiant because they have been instructed to cease and desist their infringement but have not ceased their infringing activities.

    Bravado believes the website’s selling of these items “has and will infringe upon and dilute the Michael Jackson trademark.”

    Bravado is asking for an injunction prohibiting the website from selling or attempting to sell the merchandise, three times the website’s profits or three times the damages suffered by Bravado or the Jackson estate (whichever is greater), attorney’s fees, and statutory damages of no less than $750 for each name and/or likeness that each defendant has used on each different product.

    Prices are expected to grow for Michael Jackson autographs like the one he gave this young fan in 2002.
    That's the hope at least for many offering Michael Jackson related merchandise and memorabilia, including autographed items and domain names, in the wake of his surprising death.

    Almost 20,000 items were up for sale after his death on the popular auction site eBay, where collectors could snap up everything from the rare to the ridiculous.

    Among the many T-shirts, record albums, DVDs and posters, there were also magazines about Jackson, dolls and copies of newspapers announcing his death.

    There were Michael Jackson gloves (sparkly, of course), masks, wigs, sunglasses and fedora hats. Anyone in the mood for some senior soda could try and win an auction for an unopened six-pack of Pepsi from the 1984 Jacksons world tour.


    For those seeking to establish Web sites, domain names were available including "ILoveYouMichael.com," which was selling for the "buy it now" price of $5,000. Officials at eBay said that compared with the daily average of the week prior, Thursday's gross merchandise volume for Jackson memorabilia increased by 275 percent and sold items increased by 210 percent.

    New listings were up 61 percent, while the average selling price of items had increased by 31 percent.

    Online merchant CafePress also offered a variety of items, including mugs, "R.I.P. Michael Jackson" magnets and dozens of T-shirt designs, including one screened with a drawing of tennis legend Billie Jean King and the words "not my lover."

    Some of the hottest items may turn out to be the ones bearing Jackson's signature.

    On eBay, bids for what the buyer claimed was a signed Michael Jackson guitar had reached almost $1,300 by Friday afternoon.

    Jerry Ohlinger, owner of Jerry Ohlinger's Movie Material Store in New York, predicted that although Jackson was generous in giving autographs, the price for a legitimate autograph probably will at least double from the $150 to $300 range it was prior to his death.

    "He would sign autographs whenever he appeared in person," Ohlinger said. "For instance, he visited our store at least three times, and he signed autographs for all of the employees."

    As a comparison, Ohlinger said, an autograph for the late actress Marilyn Monroe, who also was known to sign a great deal during her lifetime, sells for about $5,000 because of great demand.

    As of Friday, items purported to be autographed photos of Jackson were ranging in price from just over $5 to several thousand dollars.

    There is no way to predict whether there will be a sudden influx in demand for Michael Jackson memorabilia and merchandise, Ohlinger said.

    All of the hoopla would probably tickle the pop icon, who Ohlinger said was himself a fan of star items.

    Whenever Jackson would visit Ohlinger's Manhattan store, he would shop for vintage photos of some of the legendary ladies of cinema, including his very dear friend Elizabeth Taylor, Ohlinger recalled.

    7/25/2010<br />Old Projects I: MJ Licensing LLC<br />I have decided to pick up old MJ projects from time to time to see what happened with them. If you are curious about any of them, message me here.<br /><br />The first choise of mine was "MJ Licensing LLC", a complete mistery for many of us. Until now.<br /><br />This story began in 1997 when a German businessman, Dieter Wiesner approached MJ for creating a soft drink called "Mystery". The project failed as soon as a competing comapany launched legal actions against the entity behind "Mystery" for trademark violation. Neverthless MJ asked Wiesner to rebuild his merchandising business in 2000. Within a few months Wiesner set up a company named "MJ Net Entertainment AG" (MJNE) and signed several strategic partners. MJ orally and in written agreements promised to give some rights to MJNE. MJ's previous licensing agent, "Signatures Network" (Sony) sued both of them for breaching a previous contract for the same rights. After years of litigations on court the parties settled the case.<br /><br />MJ set up a new company in October 2003 named "MJ Licensing LLC" (MJL) co-owned with Gunter Backer. The directors appointed Wiesner as the CEO of MJL and MJ promised him to be compensated for the loss of MJNE. Finally MJ decided not to give any rights to MJL and terminated any professional relationship with Wiesner at the end of 2003. MJ thought that Backer did not meet with all the obligations they agreed on.<br /><br />Three years after the setup of MJNE and bills amounting around $8 million Wiesner decided to sue MJ on a Los Angeles court. Until Branca and McClain filed MJ's last known will, they appointed Katherine Jackson as the Administrator of the Estate. Since mid July, 2009 Branca and McClain has been appointed as the Special Administrator of the Estate. The Judge empowered them 3 months later. Since then the Jackson family questioned their position many times with less success. The Judge approved the Special Administrators to deal with new business opportunities and creditor claims.<br /><br />No interesting hearings for the following months.<br /><br />The MJ Estate notified the court on December 22, 2009 that creditor claims might be filed no later then February 22, 2010. Some of the parties might be dismissed this March.<br /><br />- Richard Lapointe vs. Julien Entertainment: The MJ Estate is a defendant in the case. Lapointe is suing them for a failed auction where he bought some MJ related merchandises. The case will go on trial this March.<br /><br />- Bravado International Group Merchandising: The company that bought the licenses to sell MJ related merchandises still have plenty of ongoing cases due to copyright infrigment on the MJ trademarks.<br /><br />- MJ Publishing Trust: MJP is taking part in plenty of suits along with BMI due to copyright infrigments on MJ's music.<br /><br />- Citadel Ltd. vs. Frank DiLeo: DiLeo has been sued over a failed MJ concert in Tobago. Neither any of the defendants answered the case so the Judge ruled a default entry against DiLeo and his partners. It means that they will have to pay at least $300.000 to this company. MJ has nothing to do with this case.<br /><br /><br />Ongoing / Future Business Events<br />- MJ wrote a comic novel named "Fated" released this year. Credits: Written by Michael Jackson and Deepak Chopra, produced by the Estate of Michael Jackson and Liquid Comics, released by Random House/Vilard. According to them the MJ materials sold over 1 million copies in the first year of his death, and this caused a frenzy they haven't seen since forming in 1992. Pyramid markets MJ products since 2006. Bravado signed an agreement with Rubie's Costume Company to manufacture costumes based on MJ's character. Bravado partnered with Playmates Toys to create a line of collectible memorablia featuring MJ. Vaccaro won his cases both against Overtoun and Universal Express, so now he is the sole owner of the collection. The Estate reviewed the items on July 21st, 2009 and took some personal things out. The next day Vaccaro moved the whole collection from Las Vegas back to New Jersey.     Today i watched a video on YT, those secret tapes of Michael talking on the phone with his friend Glenda. There he talks about how Joseph wanted to borrow $500,000 from Michael. And Michael said that he would never give it to him, because Joseph is a VERY BAD businessman, he said that he will be happy to give it (without asking it back)to his mother but not Joseph. He was sure that he would just spend it all and Michael would never see those money again.
